INFORMATION ON VIDEO SURVEILLANCE IN OUR BUSINESS PREMISES AND PRODUCTION SITES IN ACCORDANCE WITH ART. 13 OF THE GENERAL DATA PROTECTION REGULATIONS
The data protection information below gives information on the processing of personal data in the context of video surveillance by us and the claims and rights to which you are entitled under data protection regulations. We point out the fact that video surveillance is in place across our business premises and production sites. The monitored areas are marked with appropriate signs.
Who is responsible for data processing?
The responsible party within the meaning of data protection law is:
OeTTINGER Brauerei GmbH
Brauhausstraße 8
86732 Oettingen i.Bay.
Tel.: +49 9082 708-0
Email: mail@oettinger-beverages.de
For more information on our company, details of the authorized representatives and other contact options, please refer to the legal notice on our website.
Which data are processed by us and for what purpose?
Video surveillance records features that allow you to be physically or physiologically identified as a natural person. If you drive your car in a monitored area (e.g. entrance to company premises) or park your vehicle there, your registration numberplate may also be recorded under certain circumstances. Vehicle numberplates also have a personal reference, because the license plate, in combination with information on the owner from the relevant vehicle licensing office, allows conclusions to be drawn about the natural person who is the owner of the vehicle in question.
We use video surveillance for the following purposes:
- to safeguard our domiciliary rights
- to prevent criminal offenses (in particular burglary, vandalism) and the associated disruption to operations
- to retain video footage as evidence in the event of criminal offenses being committed
What is the legal basis for this?
The legality of video surveillance is based on Art. 6 (1) f) GDPR. We use video surveillance to pursue legitimate interests. The installation of the cameras alone constitutes a preventive protective measure. Third parties who are prepared to commit crimes at our expense are far less motivated to do so if the relevant business premises are monitored. Video surveillance therefore protects our rights, in particular:
- the freedom to choose an occupation, Art. 15 EU Charter of Fundamental Rights
- the freedom to conduct a business, Art. 16 EU Charter of Fundamental Rights
- property rights, Art. 17 EU Charter of Fundamental
For how long are the data retained?
The duration of video data retention varies from site to site.
- At the Oettingen site: 3 days
- At the Mönchengladbach site: 5 days
Unless the video data is used to pursue legal claims, they will be deleted after the purpose has been fulfilled in accordance with the present data protection documentation.
To which third party recipients will the data be forwarded?
In principle, the data stored by the video cameras is only stored internally by us for the above-mentioned purposes. In particular, we do not store the data with the intention of conducting behavioral analyses.
Data is only transmitted to third parties if a video recording gives rise to a serious suspicion that the stored data indicates that one or more persons have committed or attempted to commit a criminal offense at our expense. In this case, we will forward the stored data to the relevant public authorities (police, public prosecutor’s office).
Where does data processing take place?
Your personal data will be processed at our site. In particular, no transfer to third countries is planned.
Your rights as the “affected party”
You are entitled to information concerning the personal data we process about you. Where a request for information is not made in writing, we ask for your understanding that we may then require proof from you that you are the person you claim to be. You are also entitled to object to processing within the scope of the statutory provisions. The same applies to the right to data transmission. In particular, if based on a balancing of interests, you have the right to object to the processing of your data in connection with direct marketing in accordance with the provisions of Art. 21 (1) and (2) GDPR.
